Cvijanović: All crises in Bosnia and Herzegovina are the result of external anti-Dayton interventions

Željka Cvijanović said that political crises in Bosnia and Herzegovina are the result of external anti-Dayton interventions incompatible with the democratic character of the state.

Her remarks came after a meeting of the Presidency members with Alain Berset.

Cvijanović said Bosnia and Herzegovina has experienced exactly what the Venice Commission warned about in 2004 — that foreign interventionism would create a culture of dependence on the international community.

She criticized the practice of foreign officials imposing unilateral decisions, calling it a disgrace for Europe. According to her, Bosnia and Herzegovina is unique in allowing unelected foreigners to adopt laws instead of domestic democratic institutions.

Cvijanović argued that neither the Constitution nor the Dayton Peace Agreement granted such powers to High Representatives.

She also said that dozens of people became victims of what she described as illegal decisions by unelected foreign officials, without legal accountability or effective legal remedy.

Referring to the Constitutional Court of Bosnia and Herzegovina, she said no normal state allows judges, including foreign judges, to create new constitutional solutions or alter the Constitution instead of protecting it.

Cvijanović added that some former judges later claimed in memoirs they had to consult High Representatives before issuing decisions, which she said suggests political rather than legal criteria were used.

She concluded that it is time to review all imposed decisions, remove their harmful consequences, and return decision-making in Bosnia and Herzegovina to the constituent peoples, their democratically elected representatives, and domestic institutions at all levels of government.
