“This morning, Judge Seada Palavrić is seated unconstitutionally in the BiH Constitutional Court, as, according to the BiH Constitution, she should have retired today,” wrote legal expert Ognjen Tadić on his X account.
“And they call this Bosnia and Herzegovina a state,” Tadić noted.
Tadić remarked that “if Bosnia and Herzegovina were truly a state, the court porter would have stopped Mrs. Palavrić this morning.”
“He would have confiscated her official ID and asked, ‘Whom are you here to see?'” Tadić told Srna.
In his view, since such a Bosnia and Herzegovina cannot be considered a state, Palavrić will proceed to her office, acting as if nothing unusual has occurred, fully confident that remaining silent and letting a day or two pass will be enough for the media to shift to another topic.
“Of course, Palavrić is unconcerned that, starting today, besides the fact that the diminished BiH Constitutional Court has long been without a full composition required to carry out constitutional responsibilities, there is now an additional reason for its actions to be deemed unconstitutional: the participation of a judge whose mandate has expired,” Tadić emphasized.
Judge Seada Palavrić of the reduced BiH Constitutional Court turned 70 yesterday, which, according to the BiH Constitution, is the upper age limit for judge retirement in this court.
Previously, the BiH Constitutional Court has lacked a representative from Republika Srpska and the Serb people.
