Member of the Commission to Preserve National Monuments from Republika Srpska Angelina Ošap Gaćanović told Srna that she has informed all competent authorities about the independent and unlawful conduct of the chief of staff of Bosnia and Herzegovina Presidency member Denis Bećirović, who, bypassing all procedures, delivered to the Commission a decision of the Bosnia and Herzegovina Presidency against which Serb member Željka Cvijanović had lodged a veto.
She stated that today, by email, Bećirović’s chief of staff Alija Kožljak, outside the prescribed protocol procedures, delivered to the Commission the decision of the Bosnia and Herzegovina Presidency on the appointment of Commission members, adopted by outvoting by the two members from the Federation, and against which Serb member Željka Cvijanović had lodged a veto.
“After the National Assembly of Republika Srpska, by a two-thirds majority, supported the statement of the member of the Bosnia and Herzegovina Presidency on the protection of the vital interest of Republika Srpska, the decision in question cannot produce legal effect in accordance with the Constitution of Bosnia and Herzegovina and cannot serve as a basis for action by the Commission to Preserve National Monuments, especially because it was not delivered through the prescribed procedures,” Ošap Gaćanović explained.
According to her, the Rules of Procedure of the Bosnia and Herzegovina Presidency prescribe that adopted decisions, after being signed by the chairperson, are certified with the official seal, entered into the official registry protocol and then delivered through the Presidency Secretariat to the competent institutions for further action.
“In this specific case, the act in question was not delivered through the prescribed official procedure of the Bosnia and Herzegovina Presidency, that is, by the secretary general, but rather completely unlawfully through the chairperson’s office. The act bears the seal of Bećirović’s chairperson’s office and was signed by chief of staff Alija Kožljak, which is not a method of delivering acts prescribed by the Rules of Procedure,” Ošap Gaćanović said.
She believes that this conduct by Bećirović’s office is truly shocking and, in its form, represents an attack on the Constitution of Bosnia and Herzegovina and the constitutional rights of Republika Srpska.
“If everything up to now has demonstrated the recklessness and bad intentions behind the unlawful and independent communication with UNESCO, and the giving of guarantees to UNESCO on behalf of Bosnia and Herzegovina, then moves like this now clearly indicate a total loss of direction and an attempt to impose force through unilateral, unacceptable and unlawful solutions,” Ošap Gaćanović said.
Ošap Gaćanović added that she has also informed the Commission’s professional service and its members not to act on documents delivered in this manner.
