Karan: The National Assembly is the only body that enacts laws

Professor Siniša Karan stated today, during his continued testimony before the Court of Bosnia and Herzegovina, that the Constitution of Republika Srpska does not recognize the possibility of the president refusing to sign a decree and that the National Assembly is the only body authorized to pass laws.

“The Constitution of Republika Srpska is aligned with the Constitution of Bosnia and Herzegovina,” Karan said during the trial of Republika Srpska President Milorad Dodik and acting director of the Official Gazette, Miloš Lukić.

He emphasized that imposed decisions are undermining Bosnia and Herzegovina.

Karan noted that Dodik had two options: to be judged by the people of Republika Srpska or by the Court of Bosnia and Herzegovina.

“He did not allow himself to be judged by the people of Srpska, who elected him,” Karan stated.

He explained that the president of Republika Srpska does not have the authority to influence legislative decisions or enact laws.

“The Constitution is the only framework based on which institutions pass laws,” Karan said.

Before Dodik signed the decrees, Karan noted that he had discussed the constitutional relationship between the presidency and the National Assembly with him.

Karan stressed that while Annex 10 of the Dayton Agreement is not disputed, no high representative has been or can be a legislator.

He also mentioned the oath that the president of Republika Srpska takes before the National Assembly, pledging to uphold the Constitution of both Republika Srpska and Bosnia and Herzegovina.
