Kovačević: It will never be the time to resolve property issues at the BiH level

Neither now nor ever will there be a time to resolve the issue of property at the level of BiH institutions for the simple reason that it is not within the constitutional jurisdiction of BiH institutions, stated Radovan Kovačević, a delegate of the Serbian People’s Club in the House of Peoples of the Parliamentary Assembly of BiH.

  • The issue of property was resolved by the Dayton Peace Agreement, which clearly outlines the competencies of BiH, and property is not among them. The next article of the Constitution clearly states that all competencies not explicitly listed as those of BiH, and property is not one of them, belong to the entities – Kovačević noted, responding to statements from the OHR that now, more than ever, there is an urgent need to adopt a law on “state property.”

He emphasized that it is therefore entirely clear that property issues are matters to be handled by the entities.

According to him, the only way to resolve the issue of property to be used by BiH institutions is through an inter-entity agreement.

  • This is an offer that is fully in line with the Dayton Agreement, the Constitution of BiH, and it is an offer from which we in Republika Srpska will not back down – Kovačević added.

Kovačević stated that there is no office of the High Representative in BiH because there is currently no High Representative in BiH.

He added that even if there were a High Representative in BiH, according to the Dayton Agreement, his powers are exclusively based on Annex 10, and have nothing to do with the Constitution, property, or any other issue in BiH.

  • The property issue in BiH is a fabricated problem because, I repeat, it was resolved by the Dayton Agreement, and it is an issue that is only meant to complicate relations, further deepen the crisis, and hinder the economic development of Republika Srpska and the Federation of BiH – emphasized Kovačević, who is also the spokesperson for SNSD.

The Office of the High Representative stated that now, more than ever, there is a need for the urgent adoption of appropriate legislation at the BiH level to regulate the issue of “state property” in accordance with the relevant decisions of the Constitutional Court of BiH.
