Karan: A decisive struggle to preserve the autonomy of Republika Srpska

Professor of constitutional law Siniša Karan stated that Republika Srpska is engaged in a decisive professional, political, and national struggle to preserve its internationally verified autonomy, warning that under the guise of “democratization,” efforts are being made to create a framework for constitutional changes in BiH that would ultimately lead to a unitary Bosnia and Herzegovina.

Karan reminded that the constitutional order of BiH is based on the Dayton Peace Agreement, specifically the Constitution of BiH as Annex IV of that peace treaty, and on the Constitution of Republika Srpska.

“The institutions, academic community, and society of Republika Srpska as a whole bear the responsibility of defending the agreed constitutional framework in BiH. We must resist the narrative coming from political Sarajevo, which labels everything related to the Serb people as destructive. We cannot afford to lose an autonomy that has been internationally verified,” Karan said while addressing the October Legal Days conference in Banja Vrućica near Teslić.

He pointed out that we are living in a time of instability and a period in which international law has been eroded, with part of the international community imposing arbitrary and imposed rules.

“The UN Charter is no longer respected, even by those who invoke it most often. Many international agreements that were meant to provide permanent solutions and allow signatories to shape their internal relations have been devalued,” Karan noted.

The minister stressed that it is crucial to build synergy in forming a strong and unified position on how to act in the current political moment.

As Minister for Scientific and Technological Development and Higher Education of Republika Srpska, Karan said that the task of Srpska’s representatives is extremely difficult, as it requires building and protecting a law-based state within a lawless environment such as BiH.

“We are under the occupation of an unelected foreigner, certain representatives of Western embassies, and extra-constitutional institutions like the Court and Prosecutor’s Office of BiH, as well as the BiH Constitutional Court, which has been alienated from the essence of BiH as a community of peoples. All of these actors have been systematically dismantling the Dayton Peace Agreement for decades — a treaty that is an international legal act and the foundation for the formation of BiH as it exists today,” Karan stated.

He warned that under the pretext of democratization, attempts are being made to establish conditions for constitutional changes leading to a unitary BiH, accompanied by a process of majorization and denial of the Serb people’s statehood.

“The Serb people’s fight for the rule of law stands opposed to political Sarajevo’s efforts to impose unlawful decisions through appeals to the so-called ‘spirit of Dayton’. Former high representatives have abused their mandates through unilateral interpretations, relying on pressure, blackmail, threats, suspensions, and political blockades. They have undermined the Geneva and New York principles on which BiH was founded, bringing the country into a state of permanent instability,” Karan emphasized.

He reiterated that Republika Srpska continues to face constant attempts to alter the BiH Constitution.

“We are faced with a choice — to silently legitimize what has been imposed by force, or to stand and fight for the rule of law. The framework of our freedom is Republika Srpska, as the guarantor of equality and the agreed constitutional order of two entities and three constituent peoples. The will of the people stands above everything, and no one has the right to interfere with it. The leadership of Republika Srpska has recognized these malicious policies and continues to firmly reject them, reaffirming Srpska’s sovereignty in accordance with the constitutional system,” Karan concluded.

The October Legal Days conference, an event of republic-level importance with international participation, is being held at the Hotel Kardial in Banja Vrućica and will conclude tomorrow.
