As of today, the Constitutional Court of Bosnia and Herzegovina no longer has judges from Republika Srpska

Judge Zlatko Knežević is officially retired as of today, while Judge Miodrag Simović’s mandate expires at the end of 2022.

Currently, the Constitutional Court of Bosnia and Herzegovina has six judges remaining out of nine—two Bosniaks, one Croat, and three foreign judges from Albania, Germany, and Switzerland.
The stance of the Republika Srpska leadership is that the National Assembly will not appoint the missing judges until the Constitutional Court of Bosnia and Herzegovina is reformed and the mandates of foreign judges are terminated.

They believe that it makes no sense to appoint new judges who would again be outvoted, thereby legitimizing the Court.

The President of the National Assembly of Republika Srpska, Nenad Stevandić, stated that it is entirely clear that making decisions in the Constitutional Court of Bosnia and Herzegovina without judges from Republika Srpska is a plan for the future functioning of Bosnia and Herzegovina, which needs to be prevented by the Dayton rules that require no decisions without the involvement of constituent peoples and entities.
