Doctor of Legal Sciences Ljubinko Mitrović told RTRS that everyone in Republika Srpska should be united regarding the holding of the referendum following the ruling of the Court of BiH against the President of Srpska, Milorad Dodik.
– A referendum is the highest form of direct decision-making and expression. I expect a unified position on this matter. From the National Assembly of Republika Srpska I expect seriousness, as well as a well-formulated referendum question, and for the citizens to come out and express their will – Mitrović said.
He pointed out that the illegal and illegitimate Christian Schmidt introduced a new criminal offense, imposing, like an absolutist, amendments to the Law according to which every official will be held accountable for non-compliance with his decisions.
– I fear this provision; what is happening with the President is a trial balloon, and in the coming period I am afraid that all those who are now rejoicing over Schmidt’s decisions will come under the effect of this provision, meaning every responsible official who does not comply with his decision – Mitrović emphasized.
He said it is possible that Schmidt, emboldened by what has happened, may impose a decision on “state property,” and that subsequent moves could also relate to shared history and textbooks, in which Serbs would be labeled as aggressors.
Mitrović explained that the amendments to the Criminal Code were not published in the Official Gazette of BiH, but only on the OHR’s website, and that they did not pass the necessary legislative procedure, meaning that the President was tried for an offense that never formally came into legal existence.
