Dodik seeks to restore the Constitutional Court and Court of BiH to constitutional and legal compliance

Legal expert Ognjen Tadić stated that just as U.S. President Donald Trump is trying to bring the International Criminal Court back within the boundaries of respecting its Statute, Republika Srpska President Milorad Dodik is working to restore the Constitutional Court and Court of BiH to compliance with the country’s constitution and laws.

“The misuse of judicial institutions is a key characteristic of anti-democratic and anti-sovereignist forces,” Tadić said, adding that for far too long, there has been a trend of judicial authorities detaching themselves from their own states and from the awareness that they are merely one of the three branches of government, tasked with implementing the will of the people.

Citing BiH as a clear example of judicial detachment, Tadić emphasized that for the Constitutional Court of BiH, the Court of BiH, and other judicial bodies, the country’s constitution and laws have little significance whenever they contradict the interests of organized crime, intelligence agencies, or influential foreign actors, such as U.S. Ambassador Michael Murphy or Christian Schmidt.

“We are witnessing that, just as U.S. President Donald Trump is trying to use sanctions against the ICC to bring that court back within the limits of its Statute, Republika Srpska President Milorad Dodik is trying to restore the Constitutional Court and the Court of BiH to the boundaries of constitutional and legal compliance,” Tadić stated.

According to him, this is precisely why Dodik’s proposal for a future appellate instance to be distanced from political Sarajevo has strong support, as Sarajevo is a clear example of diplomatic, criminal, and intelligence influence over the judiciary.

“I believe everyone understands this, including those lawmakers who reduce this issue to regional politics in public discussions. I doubt they are unaware that they are serving political Sarajevo,” Tadić emphasized.

He pointed out that if anyone wants to engage in regional politics, they should demand that the headquarters of Roads of Republika Srpska, the Tax Administration, the Intelligence-Security Agency (OBA), or the Central Election Commission of BiH be relocated from Banja Luka and Sarajevo to East Sarajevo.

“It must be clear that harmful manipulations regarding the location of the appellate body cannot be concealed under the guise of regional politics,” Tadić concluded.
