Miljkan Pucar, the lawyer for the acting director of the Official Gazette, Miloš Lukić, emphasized that today’s hearing before the Court of BiH demonstrated that the allegations in the indictment against Lukić are unfounded.
“We have proven that there is no form 32 in the Official Gazette of Srpska; instead, there is a document that contains all the evidence that proper preparation for printing the law was carried out and that all necessary procedures were followed. Moreover, this document carries the correct title, aggregate report, all in accordance with standards,” Pucar stated.
He added that it has been established that it is not crucial whether or not there are signatures, as no one can prohibit the Official Gazette from publishing a law adopted by the National Assembly of Srpska.
“There is a procedure in place for the Assembly to change or supplement something. We have shown that the Prosecutor’s Office of BiH did not want to provide the defense with the evidence it requested from the OHR and the Ministry of Foreign Affairs. The documentation is very clear: Kristijan Šmit has no legitimacy to be called a high representative,” Pucar noted.
He pointed out that Lukić’s defense has submitted a letter from the German Embassy stating that “Kristijan Šmit is a high representative,” but the Embassy does not have the authority to determine who is the high representative.
“After that, the OHR submits to the Ministry of Foreign Affairs of BiH that Šmit should be given an identification document granting him immunity. He can only be a German diplomat because his authority comes from Germany, not the United Nations. All high representatives have been UN officials, not representatives of the states they came from,” Pucar added.
