Tadić: Decisions of the incomplete Constitutional Court are a continuation of rejecting historical facts

Legal expert Ognjen Tadić stated that the intention of certain judges within the incomplete Constitutional Court of BiH to interfere with the educational system of Republika Srpska, by unconstitutionally assuming the court’s jurisdiction, is nothing more than a continuation of their already demonstrated rejection of historical facts.

  • “The only thing they achieve by doing this is ensuring that no one better than the incomplete Constitutional Court of BiH will emphasize to new generations the importance of learning about Radovan Karadžić and Ratko Mladić, which is good and commendable, as well as what should not have happened,” Tadić said, commenting on the court’s decision to temporarily suspend part of the Curriculum Regulation for elementary education in Republika Srpska, specifically the section on the history subject for ninth-grade students that deals with Republika Srpska and the Defense and Patriotic War.

He noted that the group of judges gathered in the incomplete Constitutional Court of BiH is tragicomical, and they do this because for decades they have been working on revising and dismantling the Dayton Peace Agreement, aligning it with the wartime goals of political Sarajevo, which were defeated both in the war and in Dayton.

  • “Previously, they challenged the fact that January 9, 1992, marked the founding of Republika Srpska, and now it seems they will dispute that Karadžić was the president of Republika Srpska and that Mladić was the commander of the Army of Republika Srpska, which, to any reasonable person, naturally belongs in a history textbook that discusses the period after the breakup of Yugoslavia,” Tadić added.

The incomplete Constitutional Court of BiH yesterday temporarily suspended the application of part of the Curriculum Regulation for elementary education in Republika Srpska and the history textbook for ninth-grade students, which covers the topic of Republika Srpska and the Defense and Patriotic War.

The Ministry of Education and Culture of Republika Srpska has assessed that the decision of the incomplete Constitutional Court of BiH to temporarily suspend part of the Regulation on the history textbook for ninth grade demonstrates an intent to harm Republika Srpska, as such actions are not in line with legal standards.
