The decision of the incomplete Constitutional Court of Bosnia and Herzegovina to uphold the constitutionality of the imposed amendments to the Criminal Code of Bosnia and Herzegovina is final confirmation that this institution has completely abandoned its constitutional role as guardian of the Constitution, Republika Srpska President Siniša Karan said.
In a statement to SRNA, Karan stressed that by accepting that an unelected foreigner can be proposer, legislator and source of law in Bosnia and Herzegovina, the Constitutional Court has demolished the foundations on which every democratic and law-based society rests.
He pointed out that there is no rule of law where a foreigner, without democratic legitimacy and without a single constitutional authorization, imposes criminal laws and prescribes criminal offences.
“But with this decision, the Constitutional Court has done something even more serious – it has confirmed that Bosnia and Herzegovina not only has never been sovereign, but that as of today it is officially a protectorate territory,” Karan said.
That is precisely why, he emphasized, Republika Srpska has the right, duty and constitutional obligation, in line with international instruments on political and civil rights that are an integral part of the Constitution, to live its own life according to the valid Constitution of Republika Srpska of February 28, 1992, which was incorporated into the constitutional order of Bosnia and Herzegovina through the Dayton Agreement.
“Republika Srpska has every right to live its own life, because the Constitutional Court is destroying Geneva and New York, the foundations of the agreement of the three peoples that were turned into a binding international treaty known as the Dayton Peace Agreement,” Karan said.
He concluded that Bosnia and Herzegovina will collapse because of those who swear by it every day while simultaneously tearing down its foundations from within, because when the guardians of the Constitution become its destroyers, not only is constitutionality endangered, but the very future of Bosnia and Herzegovina as well.
The incomplete Constitutional Court of Bosnia and Herzegovina claims that Christian Schmidt’s interventions in the Criminal Code of Bosnia and Herzegovina are in line with the Constitution of Bosnia and Herzegovina and the European Convention for the Protection of Human Rights and Fundamental Freedoms.
