Today’s decision by the incomplete Constitutional Court of Bosnia and Herzegovina declaring the previous Government of Republika Srpska “unconstitutional” raises serious doubts about the judges’ ability to understand the Constitution of BiH, said Radomir Lukić, Professor of Constitutional Law, in a statement to RTRS.
“It also raises doubts about their understanding that Bosnia and Herzegovina consists of two federal units, and that those federal units enjoy full legal autonomy,” Lukić said.
According to him, the court’s desire to claim jurisdiction over virtually everything—from mining and electricity to healthcare and beyond—is truly astonishing and goes far beyond anything previously seen in the history of constitutional courts.
“This is a new disgrace of the incomplete Constitutional Court of BiH and yet another clear indication that, in its current composition and manner of operation, with this so-called judicature, it has no place in Bosnia and Herzegovina,” Lukić concluded.
