Košarac: Decision of the incomplete Constitutional Court of BiH is unfounded and contributes nothing

The decision of the incomplete Constitutional Court of Bosnia and Herzegovina declaring the previous composition of the Government of Republika Srpska “unconstitutional” is unfounded and without legal basis, Staša Košarac, Deputy Chair of the Council of Ministers, told RTRS.

“We are fully aware that in Sarajevo the institutions of Bosnia and Herzegovina operate against the interests of Republika Srpska, its institutions, and the interests of the Serb people. Above all, the Constitutional Court of BiH acts as a political body—a political service for several Western ambassadors and for Sarajevo itself—seeking time and again to issue decisions against Republika Srpska. Such a decision contributes absolutely nothing,” Košarac said.

He stressed that the very composition and conduct of the Constitutional Court of BiH are questionable.

“This must be said, first and foremost, because decisions are being made without the participation of the Serb people. We live in a country founded on two entities and three constituent peoples. A Constitutional Court that is meant to safeguard the Constitution of BiH and constitutionality is, in fact, acting outside the Constitution,” Košarac noted.

He emphasized that the decision will not discourage Republika Srpska.

“This is a clear message to us that institutions at the level of BiH have a serious problem with the capacity and sovereignty of Republika Srpska and with its credible policies. We will, of course, in line with our Constitution and our policies, continue to pursue a responsible course that ensures stability and development for Republika Srpska,” Košarac concluded.
