Lawyer Milko Grmuša told RTRS that the process against the president of Republika Srpska, Milorad Dodik, is entirely political, as he is being tried for an act that does not exist and was imposed by decree by Christian Schmidt.

Grmuša suggested that the referendum question in Republika Srpska should read: “Do you support an unelected foreigner making decisions in your country?”

He emphasized that the current crisis did not start yesterday or ten days ago, but in 2015, when the Constitutional Court of BiH first overstepped its authority by ruling that Republika Srpska Day was not in accordance with the Constitution of BiH.

  • “One year after this completely unnecessary decision, Bakir Izetbegović filed a lawsuit against Serbia for genocide, which destroyed the possibility of reconciliation,” Grmuša recalled.

He added that from that time until today, the situation has been in constant crisis.

  • “In May 2021, Valentin Inzko resigned. Outside the decision of the Security Council and the Peace Implementation Council (PIC), a decision was made on his successor in a very controversial manner. Two months after his resignation, Inzko imposed a decision banning the denial of genocide. Serb parties initially decided to leave the joint institutions, but returned after a month, breaking their word,” he noted.

According to Grmuša, this was when foreign actors realized that they could make and impose decisions.

However, he sees this situation as an opportunity for catharsis in Republika Srpska – to not only resolve this problem but also numerous chronic issues.

  • “For Serbs west of the Drina, it has never been easy, but we have a Republika Srpska for which we bled in the war – that is the most important historical achievement of my parents’ generation. The values of the Serb people are true, and Republika Srpska will prevail,” he stressed.

Grmuša believes that a major mistake of Republika Srpska was adopting the law on non-implementation of Constitutional Court of BiH decisions, as this court exists in the constitution, and for the first time, under pressure from its own decision, Republika Srpska “turned its back” on the constitution.
