Bubić: The ultimate goal of the verdict — to ban Dodik from performing presidential duties

The ultimate goal of the verdict against the President of Republika Srpska, Milorad Dodik, was to ban him from performing his duties, said his attorney Goran Bubić.

“That was clearly the primary aim of the criminal proceedings, along with the humiliation of the Constitution of Republika Srpska,” Bubić stated.

He announced that the legal team would contest this and submit a request for a provisional measure to delay enforcement.

Bubić emphasized that the verdict was based on so-called “generally known facts,” a concept not recognized by criminal procedure law.

“That is a term from civil procedure. However, this is a criminal case governed by its own strict rules. Any human action — in this case, the question of Christian Schmidt’s appointment and the so-called Bonn Powers — cannot be treated as generally known facts,” Bubić explained.

He added that such matters must be proven in court and cannot be presumed as natural phenomena or historical events.

“It is unacceptable that these were not substantiated in the proceedings. Any human action must be proven if contested by the opposing side,” he stressed.

Bubić stated that the issue of Schmidt’s appointment was incorrectly transferred into the realm of legal interpretation, while it should have first been addressed as a factual matter.

“Before assessing whether something was lawful, one must first establish whether it actually occurred,” Bubić concluded.
