Attorney Goran Bubić stated that the defense of the President of the Republika Srpska, Milorad Dodik, has submitted extensive objections to the evidence and responses of the Prosecutor’s Office of BiH in the proceedings against him and the acting director of the Official Gazette of the Republika Srpska, Miloš Lukić.
Bubić mentioned that during today’s hearing, the defense for the second defendant presented evidence.
He noted that the Prosecutor’s Office is attempting to include correspondence between the Prosecutor’s Office and employees of the Office of the High Representative, even though BiH does not have a high representative at all.
“On one hand, we have a very deferential address from the Prosecutor’s Office in those letters, which is not proportional to the authority of an agency that a prosecutor’s office should represent in a country. On the other hand, we have incredible responses that would be shocking if we had received them 200 years ago, rather than today in the 21st century. These letters exclude any authority of the Court of BiH and deny the defense’s right to engage with Annex 10 of the Dayton Agreement,” said Bubić.
He pointed out that today’s hearing highlighted the lack of equality between the defense and the Prosecutor’s Office before this institution, confirming that this is a process aimed at eliminating Dodik from political life.
“We noticed that the Prosecutor’s Office submitted evidence to the Court before the Court made a decision on the acceptance of that evidence. This undermines the standard of a fair trial, which aims solely to eliminate the President of the Republika Srpska, Milorad Dodik, from political life,” he emphasized.
Bubić also stated that the constitutional rules, which stipulate that a regulation cannot come into effect before it is published, are completely disregarded, and entirely unacceptable theses are being presented.
“An example of contradiction is the behavior of Kristijan Šmit and the current employees of the OHR. Why did Kristijan Šmit, in his decision on July 1, annul the Law on Amendments to the Law on the Publication of Regulations in the Official Gazette of the Republika Srpska, if that is not relevant?” Bubić asked.
