President of the Academy of Sciences and Arts of Republika Srpska, Rajko Kuzmanović, stated that the adoption of the Constitution of Republika Srpska in 1992 was a prestigious state-building event that created the legal-political conditions for the functioning of Republika Srpska.

Kuzmanović reminded that numerous state-legal events occurred in January and February 1992, among which was the establishment of Republika Srpska on January 9th.

“The adoption of the Constitution of Republika Srpska was another prestigious state-building event,” Kuzmanović emphasized.

He highlighted that the Constitution established key institutions of Republika Srpska, such as the President of the Republic, the National Assembly of Republika Srpska, the Government of Republika Srpska, and the judicial system including the Constitutional Court of Republika Srpska.

“These created the legal-political conditions for the full functioning of Republika Srpska and its institutions,” Kuzmanović explained.

He noted that the Constitution of Republika Srpska was modeled after the classic model of the European legal school and significantly differs from the Anglo-Saxon type of constitution.

“Every constitution, including the Constitution of Republika Srpska, is a barrier to the surge of numerous negative actions,” Kuzmanović stressed.

He mentioned that many international factors, led by the OHR and the High Representatives, focused on the Constitution and the constitutional order of Republika Srpska.

“They violently attacked the Constitution of Republika Srpska, and their changes resulted in about 114 amendments to the Constitution,” Kuzmanović highlighted.

He pointed out that it is evident that a vast majority of the Constitution has been devastated, but what remains and functions protects the citizens, the legal system, and the order of Republika Srpska.

“However, it would be necessary, if conditions ever permit, to approach the drafting of a new constitution. It is known that constitutions, if they cannot be applied, then they do not function and do not exist. Our Constitution, despite all these numerous irregularities, contradictions, and negatives, functions,” Kuzmanović emphasized.

Kuzmanović believes that, in any case, the current actions of the institutions of Republika Srpska will enable the protection of the legal order, the rights of citizens, property, and all other processes and relations in the Republic.

The Assembly of the Serb People in BiH adopted the Constitution on February 28, 1992, which was unanimously adopted on the foundations of the Declaration of Establishment, and which guaranteed full equality and equality of the peoples and citizens of the Republic.

The highest legal act of Republika Srpska, which is still in effect today with certain amendments, was adopted before the outbreak of tragic conflicts and the unilateral Bosniak and Croatian declaration of independence of BiH after a referendum held on March 1, in which Serbs did not participate.
