Milan Tegeltija, an advisor to the President of the Republic of Srpska and a legal expert, stated in our Morning Program that the Constitutional Court of BiH has turned into its opposite – an institution that, with its decisions, raises tensions in society.
He highlighted that this is a major problem.
“We are facing an absurd situation where the Constitutional Court of BiH steps out of its constitutional framework,” said Tegeltija.
He mentioned the need to separate the judiciary at the level of BiH and at the entity level, as well as to distinguish the issue of the Constitutional Court of BiH.
“The Constitutional Court of BiH is a political body by its constitutional structure. The Constitutional Court of BiH has a constitutional basis, but it steps out of its constitutional authority, imposing itself as a legislator. It changes the parliament, acts beyond the Constitution, and effectively enacts regulations,” Tegeltija explained.
He emphasized that the Constitutional Court should only review whether a law is in accordance with the Constitution.
“The Constitutional Court does not have the authority to make decisions. It imposes itself as a legislator and acts beyond the constitution,” Tegeltija was clear.
He stressed that we are in an absurd situation where the Court and the Prosecutor’s Office of BiH operate without a constitutional basis.
“We need to question whether we have legal certainty. Because if there is no predictability, then we do not have legal certainty,” Tegeltija highlighted.
