“The unconfirmed foreigner, Christian Schmidt, today stated himself as the German tourist in Bosnia and Herzegovina who wasn’t confirmed by the UN Security Council and lacks legitimacy as the High Representative.

An ATV journalist questioned him at a media conference today about the approval from the UN Security Council, which appoints the High Representative, something Schmidt doesn’t have.”

“Schmidt responded by stating that he has confirmation from the PIC, apparently unaware that the PIC is not a Dayton category and lacks the legal authority to appoint a new High Representative.

“The question isn’t whether someone confirmed me or not. I was appointed correctly because the body that appoints the High Representative is the Peace Implementation Council. They received a proposal from the former German Chancellor Angela Merkel’s office, and I was appointed in June or July 2021,” Schmidt said in response to our journalist’s question.

The question arises about the connection between the appointment of the High Representative in BiH and the PIC and the German Chancellor.”

“The PIC, as a self-proclaimed group of countries and organizations without a mandate or authority from any international institution, lacks any legal personality or authority to appoint a High Representative because such authority must be based on law.

The only possible sources of authority to appoint a High Representative are the Dayton Agreement and the UN Security Council, and neither the Dayton Agreement nor the UN Security Council has granted such authority to the PIC.

Schmidt should be aware that the signatories of Annex 10 of the Dayton Agreement select the High Representative, and the UN Security Council confirms them, but neither has occurred in his case.”
