Mitrović: Only the signatories of Annex 10 can appoint and evaluate High Representatives

Legal expert Slavko Mitrović stated that only the signatories of Annex 10 of the Dayton Peace Agreement are authorized to appoint and evaluate High Representatives, and that only they can request and propose their appointments.

Mitrović questioned whether this is understood by what he described as the usurpers from the now non-existent Peace Implementation Council (PIC) and its “phantom Steering Board.”

  • The selection of the High Representative is the exclusive competence of the signatories of Annex 10 of the Dayton Peace Agreement, after which the appointment is confirmed by the UN Security Council. That is why he is the High Representative of the signatory parties of Annex 10, acting as their authorized representative, because they established the position and assigned its tasks – Mitrović wrote in a column for Glas Srpske.

He stressed that, for this reason, the High Representative cannot be considered a representative of the “international community,” nor even of the United Nations.

  • I do not know whether the judges of the Constitutional Court of BiH have ever carefully read the Constitution of BiH. Had they done so, they would have annulled all acts imposed by Christian Schmidt, especially the decision introducing the criminal offense of “non-compliance with my decisions.” That would have rendered void the verdict against Milorad Dodik delivered by Sena Uzunović, as well as the second-instance ruling of the same unconstitutional Court of BiH – Mitrović stated.

He argued that what he called the “anti-Dayton BiH” exists only artificially and without proper constitutional foundations.

  • The BiH entity does not even possess the constitutional competences and powers for establishing and operating numerous unconstitutional institutions that have emerged over the years as a result of impositions by High Representatives, later confirmed by the Constitutional Court of BiH, all supported by statements from the PIC, a self-appointed body of self-appointed countries and organizations without any basis in the Dayton Agreement or Annex Four, the Constitution of BiH – Mitrović wrote.

He also pointed out that there are now announcements that a new High Representative could be selected at a PIC session in early June, following the resignation of Christian Schmidt.

  • But that PIC has effectively not existed for 26 years, ever since 2000 – Mitrović concluded.
