Political Sarajevo must not take the process of addressing constitutional issues to the very end, because the outcome would be worst for them, said legal expert Ognjen Tadić in RTRS Morning Program.
“What we are now reading about the decision of the truncated Constitutional Court of Bosnia and Herzegovina is unclear to anyone. Even regarding this new request, we do not know what exactly it says. The other side is not addressing the public or explaining what their goal is,” Tadić said.
However, Tadić emphasized that the most important point is that the decision of the truncated Constitutional Court regarding the first Government led by Savo Minić fully confirms the position of Republika Srpska.
“We said that they have no right to make such decisions, that only the Constitutional Court of Republika Srpska does. The truncated Constitutional Court of Bosnia and Herzegovina claimed that there was a dispute between Bosnia and Herzegovina and Republika Srpska. De facto, such a dispute did not exist. It was invented in order to give the truncated Constitutional Court room to make a decision,” Tadić stated.
He added that no one knows what dispute is actually in question.
“They invented a dispute to satisfy the needs of political Sarajevo. They ‘shot a dead horse,’ so to speak. The subject of discussion was a Government that no longer exists,” Tadić said.
He stressed that they were afraid to declare all decisions of the first Government led by Savo Minić unconstitutional, because that would also render unconstitutional all decisions of the Federation of Bosnia and Herzegovina Government and Christian Schmidt.
“That would mean that all decisions of the Federation Government over the past three years would become unconstitutional, and Schmidt installed that Government. The decisions of the Federation Parliament proposed by that Government would also be unconstitutional,” Tadić explained.
He noted that this is why they inserted a sentence stating that the decision does not prejudge the decisions of the Republika Srpska Government from that period.
“They essentially want to dismantle the agreement between Republika Srpska and the United States, to prevent the victory of Siniša Karan, and to introduce legal chaos in Republika Srpska. The crisis continues because the problems are created by Christian Schmidt, who wants to entrench himself in the position of High Representative and govern. Their goal is for Republika Srpska to disappear, and that is the reason for this request,” Tadić said.
He pointed out that political Sarajevo itself has numerous unresolved issues.
“Nermin Nikšić was appointed Prime Minister unconstitutionally, the Constitutional Court of Bosnia and Herzegovina is not fully staffed, and there are judges who should already be retired,” Tadić added.
Tadić concluded by saying that Republika Srpska, unlike Sarajevo, has conducted all its actions in accordance with the Constitution.
