The General Framework Agreement for Peace in BiH, one of the most significant documents of international law after the Second World War, confirmed the state-forming status of Republika Srpska as a signatory to all 11 annexes of the agreement — and an indirect signatory to the main peace accord — which was not the case with the Federation of BiH, legal expert Slavko Mitrović stated.
Mitrović noted that the Dayton Agreement served as the foundation for building peace and restoring trust among the three warring sides, but also represented a return to the Cutileiro Plan proposed by the international community in early 1992, drafted to prevent a civil war.
“The Cutileiro Plan envisioned the constitutional framework for a new organization of BiH. Each of the three constituent peoples — Bosniaks, Serbs, and Croats — would have its own federal or autonomous unit, with BiH as a loose community. But the Bosniak leadership wanted a unitary state in which they would have dominance over the other two peoples,” Mitrović wrote in a column for Glas Srpske.
He pointed out that the Constitution of BiH, one of the most important annexes of the Dayton Agreement, states that BiH is “a democratic state that operates under the rule of law and holds free and democratic elections,” but that the reality is the opposite.
Mitrović argues that what is unfolding is a rule of terror carried out by structures centered in Sarajevo — a “Sarajevo joint criminal enterprise against peace, and in fact against Republika Srpska.”
He added that the actions of various actors — including some, such as the Peace Implementation Council, who are not even mentioned in the Dayton Agreement — have pushed the already fragile “state” into its greatest crisis.
Mitrović said that the High Representatives and the OHR, who are included in Annex 10 of the Dayton Agreement, have turned into dictators, turning BiH into a colony and protectorate. Instead of applying the law to build peace, trust, and reconciliation, as Dayton clearly defined through its annexes as parts of an international treaty, the dismantling — or rather the destruction — of the agreement began.
He stated that, alongside the High Representatives, the Constitutional Court of BiH has played a role in constructing BiH as a false state, issuing numerous decisions without constitutional basis — because such a basis does not exist — while also confirming unlawful decisions imposed by the High Representatives.
Mitrović noted that Christian Schmidt is not a High Representative, that neither Russia nor China — permanent members of the UN Security Council — recognize him, and recalled that Schmidt was not even invited to the UN Security Council session on 31 October this year.
Although Schmidt was not appointed in accordance with UN Security Council confirmation, he added, that did not stop him from creating chaos and the greatest crisis so far — following the agenda of former “malicious and spiteful” U.S. Ambassador to BiH Michael Murphy.
“The only way to end this chaos is to erase everything Schmidt has done, especially the case brought against Milorad Dodik before the unconstitutional Court of BiH, based on an indictment from the unconstitutional BiH Prosecutor’s Office. Dodik has been banned from political activity for six years. Coincidentally, all members of the unconstitutional judiciary who indicted and judged Dodik are Muslims/Bosniaks,” Mitrović said.
He added that the decisions of the unconstitutional Court of BiH are followed by decisions of the illegally appointed Central Election Commission (CEC), whose members are serving expired terms, and that stripping the President of Republika Srpska of his mandate is contrary to the Constitution.
“The CEC’s imposed early elections for the President of Republika Srpska on 23 November will once again confirm the will of the people to preserve Republika Srpska — to choose its own representatives, and not those selected by foreigners and the Sarajevo JCE (joint criminal enterprise), supported by a coalition of ill-intentioned opposition,” Mitrović concluded.
