Mazalica: It is crucial for Srpska to protect its constitutional order

Protecting its constitutional order and highest officials within its institutions is of utmost importance for Republika Srpska. This is why the Draft Law on the Protection of Srpska’s Constitutional Order, which defines specific criminal offenses related to attacks on the constitutional system, is a significant legal step, stated Srđan Mazalica, head of the SNSD parliamentary group in the National Assembly of Republika Srpska.

Mazalica emphasized that the proposed law includes the establishment of a Republican Special Prosecutor’s Office and Court, which marks a major difference from the existing judiciary system.

He pointed out that this draft law is synchronized with the legal acts adopted at the 17th special session of the National Assembly of Srpska and that the special prosecutor’s office and court do not contradict other laws governing the judiciary.

Mazalica also reminded that the High Judicial and Prosecutorial Council (HJPC) of BiH has been legally banned from operating in the territory of Srpska.

He explained that the HJPC consists of representatives of judges, lawyers, and prosecutors from the other entity, which Srpska has prohibited by law. Therefore, it is illogical for this institution to be responsible for or concerned with protecting Srpska’s constitutional order.

  • Thus, prosecutors, including the Chief Prosecutor, investigators, and judges, will be elected by the National Assembly of Republika Srpska as the highest legislative body, where laws and the Constitution itself are enacted to safeguard the constitutional order – Mazalica stated.

The President of the National Assembly of Republika Srpska, Nenad Stevandić, announced that a 19th special session will be held tomorrow to discuss the proposal for adopting a new constitution. Following this session, another special session will take place to consider the Draft of the New Constitution and the Draft Law on the Protection of Srpska’s Constitutional Order under urgent procedure, at the request of the President of Republika Srpska.
