Legal expert Ognjen Tadić told RTRS that the Court of Bosnia and Herzegovina is obligated to restart the proceedings against the President of Republika Srpska, Milorad Dodik, and the acting director of the Official Gazette, Miloš Lukić.
Tadić emphasized the need for reasonable decision-making.
“There are at least two reasons why the Court must reasonably decide to restart the proceedings. The first reason is that it is legally required—this is not a matter of discretion or preference. The law explicitly states that the trial must start over if more than 30 days have passed since the beginning of the main hearing,” Tadić stated.
As the second reason, he pointed out the political nature of the case.
“Since the beginning of the trial, witnesses have characterized this as a political rather than a legal process, and even actors from Sarajevo have acknowledged this,” Tadić said, adding that the Prosecution aims to present a political case as a legal one.
The trial of President Milorad Dodik and acting director of the Official Gazette Miloš Lukić for “non-compliance with the decisions of Christian Schmidt” is set to continue today at the Court of Bosnia and Herzegovina.
