The first Constitution of Republika Srpska, proclaimed 34 years ago, and the historic decision of Serb MPs in Sarajevo to establish the Assembly of the Serb people in BiH marked the creation of Republika Srpska, lawyer Ognjen Tadić told SRNA.
“The Assembly of the Serb people in BiH was founded on 24 October 1991, after Serb MPs were outvoted in the Assembly of SR BiH on 14 October. The Assembly then called a plebiscite on the stay of the Serb people in a common state of Yugoslavia, in which Serbs in BiH voted almost 100 percent in favour of that option,” Tadić recalled.
He emphasized that Muslims and Croats did not recognize the results of that plebiscite, after which all Serb MPs from all parties in the Assembly of SR BiH continued their work in the Assembly of the Serb people in BiH and began adopting acts that constituted Republika Srpska.
“Of the roughly ten constitutive acts that form the constitutional-legal basis for the creation of Republika Srpska, two are the most significant – the Declaration on the Proclamation of Republika Srpska and the Constitution of Republika Srpska. The Assembly of the Serb people in BiH adopted the Declaration on 9 January, and the Constitution on 28 February 1992,” Tadić stated.
The Constitution of Republika Srpska is the only constitutional-legal act in the territory today known as BiH that was created before the war and that is the result of the democratic will of the people.
This essentially and permanently defined Republika Srpska as a peace-oriented and democratic community, created on the right of self-determination of the Serb people and shaped to be a country for every person who lives in it, regardless of which people or faith they belong to, their gender, age, political affiliation or property status.
The vitality of this fundamental idea of the Constitution of Republika Srpska has not been diminished even despite numerous amendments, including those imposed, by which attempts were made to undermine this foundational constitutional idea of Republika Srpska.
