If the Constitutional Court of Bosnia and Herzegovina believes that the decisions of an unelected foreigner can be read as law, then this is not a constitutional state, said President Milorad Dodik.

“And that is so — purely from a legal standpoint,” Dodik stated.

He emphasized that the Constitutional Court of BiH cannot pass decisions that contradict the Constitution of BiH, the Constitution of Republika Srpska, or the Constitution of the Federation of BiH.

“In its previous rulings, which are also cited in the appeal, the Court itself stated that no decision can contradict the Constitution of Republika Srpska. Even if we hypothetically accept that Schmidt is someone with authority, the decrees in question were signed before his decision. The Constitution of Republika Srpska obliges the president to sign decrees, which the Court itself could not dispute, since it has already ruled that decisions cannot violate the constitutions of Srpska, BiH, or the Federation of BiH,” Dodik explained.

He stressed that the entire process has been political from the very beginning.

“If the Constitution of BiH says that laws at the state level can only be adopted by the Parliamentary Assembly of BiH, and the Constitutional Court ignores that — then what kind of Constitutional Court is that? We want to resolve this case within the BiH framework so that we can proceed to international institutions,” Dodik said after a meeting with Metropolitan Jefrem in Banjaluka.
