Attorney Nebojša Pantić stated in RTRS’s Special program that Christian Schmidt cannot impose laws, not even under the so-called Bonn Powers to which he refers.
“Schmidt annulled a law signed by the President of Republika Srpska. He annulled it seven days earlier. To put it simply: it’s like shooting a dead man after a week and then declaring the shooter guilty of his death,” Pantić said.
He emphasized that from a criminal law perspective, the Appellate Panel must issue an acquittal.
“Milorad Dodik did not commit any criminal offense,” Pantić said firmly.
Pantić explained that when the President of Republika Srpska signs a decree, it has not yet been published in the Official Gazette at that moment.
“I personally believe that Judge Staniša Gluhajić is ill—because I know him personally, and I know he is genuinely unwell and justifiably not presiding over the Appellate Panel for that reason. The defense rightly requested the recusal of two judges, and that request was grounded in law. However, in our legal system, legal practice often overrides the law,” Pantić concluded.
