Dakić: The most important issue right now is the interpretation of the Dayton Peace Agreement

Dragan Dakić, professor of international law at the Faculty of Law in Kragujevac, stated that the acts recently adopted by the National Assembly of Republika Srpska represent an attempt at peaceful resolution of the situation in BiH within the framework of international legal mechanisms, emphasizing that the most important current issue is the interpretation of the Dayton Peace Agreement.

Dakić pointed out that this year marks the 30th anniversary of the Dayton Peace Agreement, which, in his view, is a sufficient period to assess its effects and applicability.

“In the current context, the interpretation of the Dayton Agreement is of utmost importance,” he said.

“If we look at how the agreement has been implemented over the past 30 years, especially the aspect of the High Representative and Annex 10, it is clear that Christian Schmidt cannot, under any legal basis, even be considered a High Representative—let alone exercise such powers in BiH or intervene in its legal system,” Dakić stressed.

He stated that BiH needs to find internal dialogue.

“We see a possible solution through arbitration—not within a political forum, but through a judicial forum—because this is essentially a legal dispute based on treaty law, rather than political law,” Dakić said.

He emphasized that central institutions of authority have for decades unilaterally altered the content and meaning of the Dayton Peace Agreement through their actions.

“That is why today, it is difficult to find a political framework for resolving this issue. What is needed is an authoritative interpretation within the context of international treaty law—an answer to the question of who is right and who should adjust their behavior,” Dakić concluded.
