The Prosecutor’s Office of BiH, whose authority has been legally banned in Republika Srpska, has issued an arrest warrant for Republika Srpska President Milorad Dodik, Prime Minister Radovan Višković, and National Assembly Speaker Nenad Stevandić, ATV reports.
According to available information, the warrant was issued by prosecutor Ćazim Hasanspahić, and the unconstitutional Prosecutor’s Office is accusing them of committing the criminal offense of “attacking the constitutional order.”
The Prosecutor’s Office has issued the arrest order to judicial police and has requested the assistance of the Republika Srpska Ministry of Interior (MUP) as well as SIPA—the latter also being banned from operating in Republika Srpska.
Dodik’s lawyer: No official summons received
Milorad Dodik’s lawyer, Goran Bubić, stated that, as Dodik’s legal representative, he has not been informed of any official summons from the unconstitutional BiH Prosecutor’s Office under the applicable Criminal Procedure Code (ZKP).
- My suggestion, and even my plea, is that my fellow prosecutors should seriously consider the fact that Schmidt has not been confirmed by the UN Security Council, Bubić emphasized.
BiH Court, Prosecutor’s Office, SIPA, and HJPC declared unconstitutional in Srpska
As a reminder, Issue No. 19 of the Official Gazette of Republika Srpska contains decrees proclaiming four laws adopted at the Special Session of the National Assembly of Republika Srpska on February 27:
- Law on the Non-Application of Laws and the Prohibition of the Activities of Unconstitutional BiH Institutions
- Law on the High Judicial and Prosecutorial Council of Republika Srpska
- Law on Amendments to the Criminal Code of Republika Srpska
- Law on the Special Register and Public Work of Non-Profit Organizations
These laws, among other things, explicitly prohibit the operation of the BiH Court and Prosecutor’s Office, SIPA, and the High Judicial and Prosecutorial Council (HJPC) within the territory of Republika Srpska.
