Tadić: Judges in Sarajevo and their politicians are jointly dismantling Dayton

Legal expert Ognjen Tadić stated that judges in political Sarajevo disregard the laws of Bosnia and Herzegovina in the same way that their politicians undermine the Dayton Agreement and the Constitution of Bosnia and Herzegovina.

Tadić emphasized that they are working together to dismantle the Dayton Peace Agreement and remove those who oppose them.

“Anyone who doubts this should read Article 251 of the Criminal Procedure Code of Bosnia and Herzegovina and see for themselves,” Tadić wrote on the social media platform X.

According to this article, which regulates the continuation of a postponed main hearing, a trial that has been postponed must start over if the composition of the panel has changed or if the postponement has lasted more than 30 days. However, with the consent of the parties and the defense, the panel may decide not to reexamine witnesses and experts or conduct a new investigation, instead relying on previously given witness statements and expert testimony, as well as previous investigation records.

The defense of Republika Srpska President Milorad Dodik has requested that the Court of Bosnia and Herzegovina restart the trial against him and acting director of the Official Gazette Miloš Lukić due to the expiration of the 30-day period since the last hearing in the case concerning the “non-compliance with the decisions of Christian Schmidt.”

Defense attorneys stated that the Court of Bosnia and Herzegovina violated the law to the detriment of the defense at yesterday’s main hearing against Dodik and Lukić when Judge Sena Uzunović rejected their request to have the indictment reread and witnesses re-examined. The judge justified the decision by calling the request “unfounded” and arguing that it would “prolong the proceedings.”
