Tadić: It is finally clear that BiH has no jurisdiction to pass laws on state property

Legal expert Ognjen Tadić stated that the decision by the Collegium of the House of Representatives of the Parliamentary Assembly of BiH—that the BiH Presidency is not an authorized proposer of laws on state property—is the only possible outcome. He emphasized that the decision had been anticipated by the Serb member of the BiH Presidency, Željka Cvijanović.

“Such a decision was anticipated by the Serb member of the BiH Presidency, Željka Cvijanović, who acted perfectly by refraining from vetoing the unconstitutional proposal. Instead, she allowed the Parliamentary Assembly of BiH to block the proposal, which was forwarded from the Presidency by Željko Komšić and Denis Bećirović,” Tadić told SRNA.

He added that after this 14-year-long saga, it is clear that BiH does not have the jurisdiction to adopt such a law. This definitive stance, established in the Parliamentary Assembly, spared Republika Srpska from accusations of obstruction.

The Collegium of the House of Representatives of the Parliamentary Assembly of BiH reviewed the draft law on state property proposed by the BiH Presidency but did not reach a consensus, ruling that the Presidency is not an authorized proposer of laws according to the BiH Constitution.

“We inform you that the Collegium of the House of Representatives of the Parliamentary Assembly of BiH, with one vote in favor and two against, did not reach an agreement to designate a competent committee for the review of the draft law on state property of BiH,” stated House Chair Denis Zvizdić in a notification to the Presidency.

On October 21, BiH Presidency members Denis Bećirović and Željko Komšić outvoted the Serb member Željka Cvijanović and adopted the draft law on state property.

Cvijanović had previously stated that, under the Constitution, the BiH Presidency is not authorized to propose laws regarding matters such as property.
