Banjac: Constitutional Court alters legal system with unconstitutional decisions

The president of the Narodna Partija Srpske, Darko Banjac, commented on the recent decision of the incomplete Constitutional Court of BiH to annul the Election Law of Republika Srpska, stating that this court has been altering the legal system of the state union of BiH since its inception by making unconstitutional decisions.

Banjac pointed out that, according to the Dayton Agreement, the Central Election Commission of BiH conducts elections for joint institutions, while the entities handle all other levels.

“We have no issue with the Federation of BiH deciding that CEC handles their elections, but we never agreed to that. That’s why today we have the Republika Srpska Electoral Commission within Republika Srpska. They don’t seem to understand this, and because of that, the struggle will be long and difficult,” Banjac told reporters in Trebinje.

He highlighted that the Constitutional Court of BiH has made decisions that contradict the Dayton Peace Agreement and has annulled provisions written within it.

“According to the Dayton Agreement, Republika Srpska had its own anthem and the double-headed eagle. Since that time, there has been a serious attack on the legal order and system of the state union of BiH, and consequently, on Republika Srpska, by stripping away certain rights,” Banjac emphasized.

He reiterated that the Constitutional Court of BiH is not a creator of law and cannot create law but should only interpret the Dayton Agreement.

“However, since various influences still exist here today, we have Constitutional Court judges who, I am sure, especially the foreign ones, have never even read the Dayton Agreement. Decisions are made through foreign influence, applying Anglo-Saxon law. Essentially, this mixture has reached its limit because legally, it won’t hold up,” Banjac said.

The incomplete Constitutional Court of BiH annulled the Election Law of Republika Srpska today, arguing that it is inconsistent with the Constitution of BiH and the Election Law of BiH, allegedly because it usurps the jurisdiction of BiH institutions.
